Masiyah operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Masiyah is powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions, together with any policies referenced herein (the “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Because some Masiyah products may be produced on demand, minor variations may occur between individual products where this is inherent to the production process.

Product descriptions, availability and specifications may be updated from time to time.

We reserve the right to discontinue products or limit their availability where reasonably necessary.

Nothing in this section affects your statutory rights in relation to goods that are faulty, not as described or otherwise fail to meet applicable consumer-law requirements.

SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase products from Masiyah.

After placing your order, you may receive an acknowledgement or confirmation email. We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, there is an obvious pricing or listing error, payment cannot be authorised, or we reasonably suspect fraud or misuse.

Please review your order carefully before submitting it.

If you need to request a change or cancellation, contact us as soon as possible. Some Masiyah products may enter production shortly after an order is placed, so we cannot guarantee that a requested change can be made.

Returns, cancellations and refunds are subject to our Returns & Refunds Policy and applicable consumer law.

SECTION 4 — PRICES AND PAYMENT

Prices, discounts and promotions may change from time to time.

The price charged will be the price displayed when your order is placed, subject to correction of obvious errors where permitted by law.

Any applicable delivery charges, taxes or other charges will be displayed where required before you complete your purchase.

For international orders, customs duties, import taxes or similar charges may apply depending on the destination. Where such charges are not collected at checkout, the customer may be responsible for them in accordance with applicable law.

You agree to provide accurate and complete payment and billing information.

SECTION 5 — SHIPPING AND DELIVERY

Delivery times provided by Masiyah are estimates unless expressly stated otherwise.

Some products may be made to order and fulfilled by carefully selected production partners. Processing and delivery times can therefore vary depending on the product and destination.

Where an order contains multiple products, items may occasionally be produced or dispatched separately and may arrive in different parcels.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier or customs delays. This does not affect any rights or remedies available to you under applicable consumer law.

For UK consumer orders, risk in the goods remains with Masiyah until the goods come into your physical possession, or the physical possession of a person identified by you to receive them, except where you independently arrange a carrier that was not offered by us.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their content, including Masiyah branding, logos, text, graphics, illustrations, photographs, product designs, videos and other materials, are owned by or licensed to Masiyah and are protected by applicable intellectual property laws.

Unless permitted by law or authorised by Masiyah, you may not reproduce, distribute, modify, republish, commercially exploit or otherwise use our protected content without prior permission.

Masiyah’s name, logo, product names, designs and other brand elements may not be used without permission where such permission is legally required.

Masiyah is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are made directly with Masiyah.

Shopify provides the ecommerce infrastructure used to operate our store but is not the seller of Masiyah products.

Nothing in this section excludes or limits rights or remedies that cannot legally be excluded or limited.

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is powered by Shopify, Shopify and other service providers may process certain personal information in order to provide services necessary for the operation of our store.

SECTION 17 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to the above, Masiyah will not be responsible for losses that were not reasonably foreseeable when the contract was formed or losses arising from use of products for commercial or business purposes where you purchased them as a consumer.

Your statutory consumer rights remain unaffected.

Where permitted by applicable law, you agree to be responsible for losses reasonably incurred by Masiyah as a direct result of your unlawful use of the Services or material breach of these Terms.

The remaining provisions will continue in effect.

Nothing in these Terms limits rights that cannot legally be excluded.
